Prosecutors Will Not Be Able To Retry A Johnson City Resident On Charges That He Killed His Wife 11 Years Ago. Washington County Judge Jon Kerry Blackwood Ordered The Murder Charges Against Dale Larkin Dismissed With Prejudice. Blackwood Said The State Had Not Been Able To Produce A Witness To Testify On An Independent Basis On The Cause Of Death Of Teri Larkin. Larkin Was Convicted In February 2009 For The November 2003 Death Of His Wife. Prosecutors Claim Larkin Drowned Her In A Bathtub At Their Residence. That Conviction Was Ultimately Overturned By The Court Of Criminal Appeals After The Panel Determined The Judge Erred By Allowing A Forensic Pathologist To Testify About A Second Autopty She Performed.
